SHEPHERD Chartered Surveyors is advising owners of commercial property to ensure that they have an Energy Performance Certificate in place ahead of the introduction of new legislation.
As of 9th January 2013, new legislation will come into force requiring that a building’s energy performance rating is displayed on the particulars of all properties marketed for sale or rent. From this date, all commercial properties, regardless of the length of time the building has been on the market, must have an Energy Performance Certificate in place and display the Energy Indicator on the marketing particulars.
Graeme McDonald, partner at Shepherd, said: “The need to provide an EPC on sale or rental properties imposes a duty on the building owner which, if not met, can result in enforcement action and the issue of a penalty charge notice of up to £5,000 by the Local Authority.
“It is therefore essential that measures are in place before the January deadline to avoid potential fines from the regulating body. Owners should note that properties currently being marketed by agents needs to be brought in line with the new legislation.”
